By accepting a quotation or engaging our services, you agree to the following Terms.
1. Scope of Services
Services are limited strictly to what is outlined in the approved quotation.
The following are not included unless quoted separately:
• Ongoing maintenance
• Advanced SEO
• Copywriting
• Plugin or theme license renewals
• IT support
• Server troubleshooting
• Third-party integrations
• Email configuration beyond basic setup
Any additional requests will be quoted separately.
2. Payments & Deposits
• A 50% non-refundable deposit is required before work begins.
• Projects under R25,000 require full upfront payment.
• Final payment is due before launch or handover.
• All work remains the property of Bizzexpose until paid in full.
• No refunds apply to completed work or paid deposits.
3. Revisions & Additional Work
Clients are allowed:
• 5 working days to review submissions
• 2 revision rounds included
Thereafter:
• General website updates & maintenance – R550/hour (excl. VAT)
• Website structure, layout or development changes – R950/hour (excl. VAT)
Minimum 1-hour billing applies.
4. Client Responsibilities
The Client must provide all required content within 7 calendar days of deposit.
Delays may result in:
• Project timeline extensions
• Project placed on hold
• Additional holding or reactivation fees
All content supplied must be legally owned or licensed by the Client.
Bizzexpose is not liable for copyright infringement arising from client-supplied content.
5. Ownership & Licensing
Upon full payment:
• The Client owns the final approved website content and layout.
• Domain ownership may be transferred upon request once all invoices are settled in full.
However:
Themes, plugins, hosting licenses, and commercial software remain licensed products and are not transferable.
Many professional themes (including Divi and similar frameworks) are licensed under developer agreements and cannot be reassigned to clients.
If a Client transfers hosting, they may need to obtain their own licenses directly from the service or software provider.
The website remains functional, but updates and premium features may require independent license purchases.
Bizzexpose reserves the right to display completed projects in its portfolio.
6. Hosting & Domain
Bizzexpose is not a hosting provider. Hosting is facilitated via third-party providers.
Hosting packages:
• 1GB – R100/month (excl. VAT)
• 3GB – R200/month (excl. VAT)
• 5GB – R350/month (excl. VAT)
• 10GB – R550/month (excl. VAT)
Custom packages available upon request.
Hosting includes:
• Server allocation
• Standard security firewall
• Basic uptime monitoring
Hosting does not include IT support or advanced technical troubleshooting.
Non-payment:
• Suspension after the 7th day of invoice
• R450 reactivation fee
• Termination after 2 consecutive unpaid months
• Files may be deleted
Domain fees are billed annually in advance and are non-refundable.
7. Maintenance & Technical Support
WordPress is an open-source platform. As such, it requires regular updates to:
• WordPress core
• Themes
• Plugins
Failure to update can result in:
• Security vulnerabilities
• Malware infection
• Website crashes
• Plugin conflicts
We strongly recommend a monthly maintenance plan for your protection.
Maintenance Plan – R250/month (excl. VAT)
This includes:
• Updating WordPress core
• Updating installed plugins
• Updating themes
• Basic stability checks
This plan does not include content updates, redesigns, or feature additions.
Clients are welcome to update their own websites independently and are not obligated to subscribe to the maintenance plan. However, Bizzexpose strongly recommends ongoing updates to maintain website security and stability.
8. Support Rates
Unless a maintenance agreement is in place:
• General support – R550/hour (excl. VAT)
• Structural/development support – R950/hour (excl. VAT)
Emergency after-hours support (subject to availability):
• R1,000/hour (excl. VAT)
9. Email, Security & Backups
Bizzexpose does not manage email inboxes.
Clients are responsible for maintaining independent backups unless a separate backup agreement exists.
Bizzexpose is not liable for:
• Hacking
• Malware
• Data loss
• Server failure
• Weak passwords or user negligence
10. Cancellation
• 30 days written notice required via email.
• Verbal or telephonic cancellations are not accepted.
• A R650 administration fee applies for cancellation processing.
All outstanding invoices must be settled before cancellation is finalised.
11. Limitation of Liability
Bizzexpose shall not be liable for:
• Loss of profits
• Business interruption
• Data loss
• Downtime
• Reputational damage
Total liability is limited to the amount paid for the specific service in question.
12. Marketing & SEO Disclaimer
Search engines and digital platforms are controlled by third parties.
Bizzexpose does not guarantee rankings, leads, sales, or revenue unless explicitly agreed in writing.
13. Legal & Compliance
Clients are responsible for compliance with South African laws, including POPIA and electronic commerce regulations.
14. Jurisdiction
These terms are governed by South African law.
Jurisdiction: Durban, KwaZulu-Natal.
15. Entire Agreement
These Terms & Conditions constitute the entire agreement between the Client and Bizzexpose (Pty) Ltd regarding the services provided.
No amendment, variation, or addition shall be valid unless agreed to in writing by both parties.
These Terms supersede any prior discussions, communications, representations, or agreements, whether verbal or written, relating to the subject matter herein.
